Your right to remain in or return to your home:

Married Women

* All married women have the automatic right to live in the marital home, or to return to it after a temporary absence as you have 'Occupany Rights'
* This applies even if your partner is the sole owner or tenant of the home
* If the house is in your husbands name only and he puts you out of the house or refuses to let you back in after a temporary absence, then you can seek immediate police assistance because he is breaking the law
* If the house is in your name or joint names, you have the right to get back in, even if you have to force entry.

Non-Married Women living with their partners

* If you are not married but live with your partner and are the sole owner or tenant then you do have occupancy rights and automatic right to live in the family home
* If you own or rent your home jointly with your partner then again you have occupancy rights but your partner also has this right and you would have to go to court to get an exclusion order if you want to have them removed from the home
* If your partner is the sole owner of tenant then you do not automatically have occupancy rights but can apply to the court to have this granted.
